Bombay Art Company is a curated online art platform that offers both original artworks and licensed art prints. Our print business operates on a custom print-on-demand model, while our originals are sourced directly from artists for sale through our platform.

By accessing our Website or purchasing from us, you engage in our “Service” and agree to be bound by these Terms and Conditions (“Terms”). These Terms apply to all users of the site, including browsers, buyers, and content contributors.

Please read these Terms carefully before placing any order. By placing an order, you confirm that you have read, understood, and agree to be bound by these Terms.

We reserve the right to modify or update these Terms at any time. Continued use of the Website after changes constitutes acceptance of the revised Terms.

SECTION 1 – CUSTOM PRINT BUSINESS MODEL

1.1 Dual Stream Art Platform: Bombay Art Company operates two distinct segments:

  • Original Artworks: Curated and sold directly on behalf of artists. These are one-of-a-kind pieces authenticated by the artist or authorized representative.

  • Licensed Art Prints: High-quality, authorized reproductions sourced from museums, galleries, and archival publishers.

1.2 The originals and print catalogues are mutually exclusive. We do not produce prints from artworks of artists we represent for originals unless specifically authorized in writing by the artist.

1.3 Age Requirement You must be at least 18 years old or have parental consent to place orders. By placing an order, you confirm you meet this requirement.

1.4 Prohibited Uses You may not:

  • Use our products or Website for unlawful purposes;

  • Infringe upon copyrights, trademarks, or proprietary rights;

  • Reproduce or distribute our content commercially without written authorization.

1.5 For print orders, each product is individually printed and prepared after order placement. We do not maintain pre-printed stock.

SECTION 2 – ORDER PROCESSING & CANCELLATIONS

2.1 Orders are confirmed only upon successful payment processing. Bombay Art Company reserves the right to accept, reject, or cancel any order at its discretion, including for stock unavailability, pricing errors, or operational constraints.

2.2 Fulfilment Responsibility

Bombay Art Company operates two distinct fulfilment models depending on the product type:

(a) Original Artworks

  • All original artworks are packed and dispatched directly by the artist or their authorized representative.

  • The Company acts only as an intermediary and is not liable for shipping delays, packaging defects, or transit issues once the artist has dispatched the product.

  • However, the Company will assist in communication and coordination between the artist and buyer for resolution, if required.

(b) Prints & Editions

  • All print orders are printed, packed, and dispatched by Bombay Art Company or its authorized production partners.

  • In some cases, specific print editions may be pre-designated for dispatch directly by the artist or originating gallery.

  • Where such exceptions apply, the dispatch source will be clearly communicated to the buyer at the time of order or in the order confirmation email.

(c) Disclaimer of Liability

  • The Company shall not be liable for any delay, damage, or loss arising from shipments handled directly by artists or third-party dispatchers.

  • Our responsibility for print orders ceases once the courier service confirms successful delivery.

2.3 Cancellation Policy
 

  • Cancellations are accepted within 12 hours of order placement.

  • After 12 hours, the order enters production or artist fulfilment and cannot be cancelled.

  • Once production, printing, or dispatch begins, no cancellation requests will be accepted.

  • All cancellation requests must be sent in writing to hello@bombayartcompany.com.

2.4 Production and Delivery Recommendations
 

  • Print Orders: Production begins within 24 hours of approval. Average delivery is 4–14 business days, depending on destination.

  • Original Artworks: Artists are expected to dispatch confirmed orders within 7–10 business days, unless otherwise specified.

  • Delivery timelines are indicative and may vary due to weather, courier delays, or external disruptions. Customers will be notified of any significant delays.

SECTION 3 – PRICING & PAYMENT

3.1 Pricing All prices shown on the Website are inclusive of applicable taxes (GST).The final price at checkout includes shipping and handling charges.

3.2 Price Changes Prices are subject to change without notice. Confirmed orders honor the price at time of purchase.

3.3 Payment Full payment is required at time of order placement. We accept major credit cards, debit cards, and digital payment methods as displayed during checkout.

SECTION 4 – SHIPPING & DELIVERY

Bombay Art Company fulfils orders through two separate channels:
(a) Original Artworks: 
  • All original artworks are packed and shipped directly by the artist or the artist’s authorized representative.
  • The Company acts only as a facilitating platform between the buyer and the artist and does not assume any liability for packaging quality, courier handling, or transit damage once the item leaves the artist’s possession.
  • Dispatch timelines, packing standards, and courier selection are determined by the artist.
  • The Company will, however, assist in coordination between the buyer and artist in case of delays or damage claims.
(b) Prints and Licensed Editions
  • All prints are printed, packed, and shipped by Bombay Art Company or its approved print partners.
  • In certain cases, select print editions may be pre-designated for dispatch directly by the artist, publisher, or gallery.
  • In such cases, the dispatch origin will be clearly communicated to the buyer at checkout or via email confirmation.
  • The Company will, however, assist in coordination between the buyer and artist in case of delays or damage claims.
 

4.1 Shipping Coverage We ship across India. Shipping charges are calculated at checkout based on delivery location and product specifications.

4.2 Delivery Timeline

  • Standard delivery: 4-14 business days
  • Timeline starts from order confirmation, not payment processing
  • Delivery times may vary based on location and courier service
 

4.3 Weather & Force Majeure Delays Delivery timelines may extend by 2-7 additional days due to:

  • Monsoon season and severe weather conditions
  • Natural disasters or government restrictions
  • Courier service disruptions beyond our control
  • We will notify customers of significant delays via email/SMS
 

4.4 Shipping Charges

  • Shipping charges are non-refundable
  • Calculated based on product size, weight, and delivery location
  • Final shipping cost is included in final price at time of checkout

SECTION 5 – RETURNS, EXCHANGES & REFUNDS

5.1 General Policy: Because all artworks and prints are produced or sourced specifically for each order, we do not accept cancellations, exchanges, or returns after delivery, except where an item is received damaged in transit or materially defective.

This applies to both original artworks and prints sold through the Website.

5.2 Original Artworks:

  • Original artworks are shipped directly by the artist or their authorized representative.

  • The Company acts solely as a facilitating platform and is not liable for the artist’s handling, packaging, or dispatch process.

  • Any damage or defect that arises during shipment must be reported within 24 hours of receipt at hello@bombayartcompany.com, with clear photographs of:

    1. The damaged area, and

    2. The outer packaging.

  • Once reported, the Company will coordinate between the buyer and the artist to facilitate an exchange, repair, or refund, as mutually agreed.

  • Refund or exchange decisions for originals rest solely with the artist; Bombay Art Company’s role is limited to mediation and communication.

 

5.3 Prints and Licensed Edition:

  • Prints are printed, packed, and shipped by Bombay Art Company or its authorized production partners.

  • If a print arrives damaged:

    1. Notify us within 24 hours of delivery at hello@bombayartcompany.com.

    2. Attach clear photographs of the product and packaging.

    3. Retain all original materials for inspection.

  • On approval, we will arrange replacement, reprint, or refund as appropriate.

 

5.4 Return Process (for Damaged Items)

  • After approval, we may offer:

    • Pre-paid return shipping, or

    • Authorization for self-shipment (dispatch within 48 hours).

  • All returned items must be in their original condition, including packaging, certificates, and labels.

  • Items failing inspection or received incomplete will be returned to the customer at their expense.

 

5.5 Quality Assurance:

We photograph each print before packaging as proof of accurate printing and condition.

Original artworks are shipped with artist-verified authenticity and packaging evidence.

Customized or commissioned pieces are non-returnable under all circumstances except verified transit damage.


5.5 Refund Processing:

  • Approved refunds will be processed within seven (7) working days after return acceptance or artist confirmation.

  • Refunds will be credited to the original payment method.Shipping charges are non-refundable.

  • We photograph each print before packaging as proof of accurate printing and condition.

5.6 Exclusions and Limitations:

  • Minor differences in colour, tone, or texture between the digital image and the delivered artwork or print are natural and do not qualify as defects.

  • The Company’s total liability, if any, shall be limited to the invoiced value of the item.

  • Bombay Art Company shall not be liable for delays, loss, or damage once the original artwork has been dispatched by the artist.


SECTION 6 – PRODUCT QUALITY & ACCURACY

6.1 Color Accuracy We make every effort to display colors accurately. However, actual colors may vary slightly due to:

  • Monitor/screen display differences
  • Printing process variations
  • Paper/material characteristics
 

6.2 Design Accuracy All product descriptions, sizes, and specifications are provided for guidance. Minor variations in printing may occur due to the custom production process.

6.3 Quality Standards We maintain strict quality control standards. Items not meeting our standards are reprinted before shipping.

SECTION 7 – INTELLECTUAL PROPERTY

7.1 Content Ownership All designs, images, and content on our website are owned by Bombay Art Company or used under appropriate licenses.

7.2 Customer Usage Rights Purchased prints are for personal use only. Commercial reproduction, resale, or distribution is prohibited without written permission.

7.3 User Submissions Any feedback, suggestions, or content you submit may be used by us without compensation or attribution.

SECTION 8 – LIABILITY & DISCLAIMERS

8.1 Service Availability We strive for continuous website availability but do not guarantee uninterrupted service. We may suspend service for maintenance or technical issues.

8.2 Information Accuracy While we aim for accuracy, product information may contain errors. We reserve the right to correct mistakes and update information without prior notice.

8.3 Limitation of Liability Our liability is limited to the purchase price of the specific product. We are not liable for:

  • Indirect, incidental, or consequential damages
  • Loss of profits, data, or business opportunities
  • Delays due to external factors beyond our control
  • Color variations due to display/printing differences

SECTION 9 – THIRD-PARTY SERVICES

9.1 Payment Gateways We use third-party payment processors. Their terms and privacy policies apply to payment transactions.

9.2 Courier Services Shipping is handled by third-party courier partners. We are not liable for courier service delays or issues beyond our control.

9.3 External Links Our website may contain links to third-party sites. We are not responsible for their content, policies, or practices.

SECTION 10 – PRIVACY & DATA

10.1 Personal Information Collection and use of personal information is governed by our Privacy Policy, which forms part of these Terms.

10.2 Data Security We implement appropriate security measures to protect customer information. Credit card data is encrypted during transmission.

10.3 Communication By placing an order, you consent to receive transactional emails and SMS regarding your order status.

SECTION 12 – ACCOUNT & TERMINATION

12.1 Customer Accounts Account creation may be required for order placement. You are responsible for maintaining account security.

12.2 Termination Rights We reserve the right to terminate customer access for violations of these Terms, fraudulent activity, or misuse of our services.

12.3 Effect of Termination Upon termination, pending orders will be processed, but new orders will not be accepted.

SECTION 13 – GENERAL PROVISIONS

13.1 Entire Agreement These Terms constitute the complete agreement between you and Bombay Art Company for use of our services.

13.2 Severability If any provision is deemed unenforceable, the remaining Terms continue in full effect.

13.3 Waiver Failure to enforce any Term does not constitute a waiver of our rights.

13.4 Updates We may update these Terms periodically. Continued use of our website constitutes acceptance of updated Terms.
